Avandia Class Action

Kim Orr is prosecuting a class action together with Merchant Law Group LLP against GlaxoSmithKline plc, GlaxoSmithKline LLC and GlaxoSmithKline Inc. (collectively, "GlaxoSmithKline") seeking $170 million in damages for negligence, breach of implied warranty, failure to warn and conspiracy as a result of GlaxoSmithKline's development, manufacture and sale of Avandia, Avandamet and Avandaryl (collectively, the "Drugs").

The Drugs are recommended and prescribed for the management of Type 2 Diabetes, also known as non‑insulin‑dependent mellitus or adult-onset diabetes.

The Claim alleges that the Drugs cause significant cardiovascular risks, including reduced blood supply to the heart, heart attack, heart failure, and stroke, among others. The Claim alleges that GlaxoSmithKline knew of the health risks associated with consuming the Drugs, but failed to warn doctors, patients, and regulators, including Health Canada and the FDA, of those risks.

The Claim seeks damages on behalf of all persons in Canada who were prescribed and who took the Drugs, and their family members.

Kim Orr will bring a motion for the certification of this action as a class proceeding.
