Guidant Defibrillators Class Action

The law firms of Kim Orr Barristers PC, Sutts, Strosberg LLP, Lerners LLP and Rochon Genova LLP are representing the plaintiffs in a class action against Guidant Corporation, Guidant Canada Corporation and Guidant Sales Corporation (collectively "Guidant") seeking damages for the negligent design, development, marketing and sale of certain potentially defective defibrillators and the failure to report potentially life threatening defects associated with these defibrillators.

A defibrillator is a small, implanted device used to treat irregular heart rhythms, particularly tachycardia. Commencing in May and June, 2005, Guidant revealed that certain defibrillators contained defects. The Plaintiffs allege that Guidant knew about these defects but failed to disclose them to patients, physicians and the regulatory authorities.

This Claim seeks damages on behalf of all persons in Canada who have been implanted with one of the following Guidant defibrillators and resynchronization therapy defibrillators:

By reasons released April 10 and June 17, 2008, Justice Cullity of the Ontario Superior Court certified this action as a class proceeding. Notice of the certification hearing was mailed to the Class Members in December 2009.
