Sony Television Class Action
Kim Orr is prosecuting a class action against Sony of Canada Ltd., Sony Corporation, Sony Corporation of America, Inc., and Sony Electronics, Inc. (collectively "Sony") seeking damages of $120 million as a result of the alleged negligence and other wrongful acts of Sony in respect of their design, testing, manufacture and marketing of potentially defective televisions (the "Defective Televisions").
The model numbers of the Defective Televisions at issue are:
- Sony Grand WEGA SXRD Televisions – KDS-R50XBR1 and KDS-R60XBR1;
- Second Generation Sony Grand WEGA SXRD Televisions – KDS-R60XBR2, KDS-R70XBR2, KDS-50A2000/2020/3000, KDS-55A2000/2020/3000, KDS-60A2000/2020/3000, and KDS-70Q006; and,
- Sony Grand WEGA A10 and A20 Series LCD Rear Projection HDTV Televisions – KDF-E A10, KF-E A10 and KDF-E A20.
The Statement of Claim alleges that the Defective Televisions contain a component called an optical block that has an inherent defect that manifests over time and causes video and colour anomalies to appear on the program display of the Defective Televisions (the "Optical Block Defect"). Furthermore, the Statement of Claim alleges that the Optical Block Defect severely interferes with the program display and renders the Defective Televisions unwatchable and unfit for their intended use. The Statement of Claim also alleges that Sony has known about the Optical Block Defect for a number of years, yet they continued to market and sell the Defective Televisions and failed to disclose the Optical Block Defect to the Class Members.
The Statement of Claim seeks damages on behalf of all persons, wherever resident, who purchased or otherwise acquired a Defective Television in Canada.
Kim Orr will bring a motion for the certification of this action as a class proceeding.
